Consultations

Our Professional Dental Consultation is free of charge. During your consultation a panoramic x-ray may be required to assess the state of your teeth and mouth. If you have a recent x-ray, we can use that. Alternatively you can take an x-ray in Your Country, or abroad (in Ukraine).

If for any reason you do not present yourself on time and in a state that the consultation can be performed, your appointment will be cancelled. In certain cases we may need to move your appointment. In these cases we will notify you as soon as the need for rescheduling arises, and offer you alternative times.

Along with your Professional Dental Consultation you will receive a personalised Treatment Plan which is valid for 30 days. Your final diagnosis will be set up abroad (in Ukraine), often with the involvement of further specialists (e.g., an implantologist assessing the amount and strength of your bone tissue to determine the feasibility of placing implants, etc).

Treatment Options

It is our aim that you receive adequate information on the treatment options available to you, together with their consequences, costs, and possible risks. You should be able to discuss with your dentist the options available in order to select a course of treatment that is medically sound, aesthetically pleasing, and financially affordable to you.

Please make sure you understand the implications of your treatment and the alternatives before agreeing to any treatment.

Course of Treatment

In some cases it may only become apparent after the commencement of your treatment abroad that the course of treatment discussed during your Professional Dental Consultation has to be modified. Sometimes this happens as old crowns are being removed and loose teeth pulled. At other times it may happen at the very onset when specialists are consulted. The implications of such findings will be explained, and a modified treatment plan will be agreed. In some cases the modified treatment plan may involve an extra trip abroad. During this process you may at any time decide not to continue with the treatment. In this instance you will only have to pay for treatment and laboratory work which has been provided.

“Say Cheese” Dental Tours” has the absolute right to discontinue treatment at any time without any obligation for compensation if you are not medically or mentally fit for the recommended treatment or if your payment obligations are not met.

In some cases “Say Cheese” Dental Tours” may need to make changes to your appointment time and/or the place of treatment and/or the treating specialist. In this event we will contact you to advise you of those changes at the first available opportunity.

“Say Cheese” Dental Tours” may at any time without notifying you make any changes to the Services which are necessary to comply with any applicable safety or other statutory requirements, or which do not materially affect the nature or quality of the Services.

Travel

Travel, accommodation, meals, and other ancillary expenses of treatment abroad will in all cases be your responsibility, regardless of whether those expenses are incurred as a result of consultation, treatment, checkups, guarantee work, or any other reason. Always allow plenty of time for flights as we may not be able to reschedule your appointments.

“Say Cheese” Dental Tours”

“Say Cheese” Dental Tours” acts as the Payment Representative of your dentist in collecting On-line consultation (Initial Comprehensive Assessment). “Say Cheese” Dental Tours” is authorised by your dentist to bring any action that may arise in respect of the non-payment of these charges. It is acknowledged by you that “Say Cheese” Dental Tours” (Private Entrepreneur Pavel Usoltsev, certificate # 630858 from 20/03/2007, Kiev, Ukraine) does not directly provide dental services and it is expressly agreed that no liability whatsoever will attach to it.

“Say Cheese” Dental Tours” staff may assist you with the booking of apartments, transfers, taxi, excursions, restaurants, theatres, night clubs, spas, etc., but you will be solely responsible for settling all and any costs arising directly with the service provider/operator. Under no circumstances whatsoever will “Say Cheese” Dental Tours” be liable for any losses that may arise from the performance or non performance of any service provider/operator. We encourage feedback concerning any aspect of our Terms & Conditions.

Guarantees

Different types of work are covered by different guarantee conditions. Prior to beginning treatment, the guarantee policy will be reviewed with you. After the 1^st detailed examination our dentist will prepare personal “step-by-step” Treatment Plan. Every stage of Treatment Plan will be discussed and confirmed and signed by a patient.

You will receive a detailed guarantee statement after the work is performed. The aesthetic and functional performance of the work done in your mouth will depend on the workmanship of the laboratory work involved as well as on the condition of your teeth, gums, and bones. Factors affecting the length of the guarantee period include general oral hygiene, smoking, diabetes, bone density and diet. Your guarantee will typically be conditional on regular checkups.

1) If you travel to our facility for aftercare (Ukraine), and it is determined that your work falls under guarantee, replacement or restoration of the original work will be performed free of charge.

2) If you see an independent dentist for any problem associated with the work performed by a “Say Cheese” Dental Tours” clinic dentist, we will require a detailed report from that dentist in order to properly assess your condition. If, however, the independent dentist interferes in any way with the work originally carried out by the “Say Cheese” Dental Tours” clinic dentist, you may lose the benefit of any guarantee.

3) This guarantee is provided by our clinic in Kiev, Ukraine, full details will be provided upon request. “Say Cheese” Dental Tours” is not liable in any circumstances for cases arising from this guarantee.

Failure to bring your complaint to the attention of your dentist or “Say Cheese” Dental Tours” at the earliest opportunity will be considered proof that the services were satisfactorily provided.

If your dental problem can not be satisfactorily resolved over the telephone, you may need to see a dentist.

(1) Our preference is for you to travel to the clinic that treated you originally.

(2) We will try to organise for the dentist who carried out your treatment to see you again, but this may not always be feasible; consequently another dentist associated with “Say Cheese” Dental Tours” may need to see you.

(3) As a third alternative, you may see a local dentist with your problem.

If it is determined that your work falls under guarantee, it will be treated according to the conditions described in the Guarantee section.

Disclosure

In order to perform our services you will be required to disclose certain personal information, including your personal data, travel plans, and health records (“the Information”) to “Say Cheese” Dental Tours” or any agent appointed by it to receive such information. No liability will arise in respect of any losses suffered by you where the Information disclosed is found to have been incorrect or incomplete. It is your sole responsibility to ensure that the Information provided is accurate and to immediately notify “Say Cheese” Dental Tours”, or any agent appointed by it to receive such information, of any changes to it.

Confidentiality

“Say Cheese” Dental Tours” acknowledges that it will in the course of the provision of the Services be provided with or have access to information which is confidential to you (‘Confidential Information’). “Say Cheese” Dental Tours” shall not at any time make use of or divulge or permit any person to make use of or divulge any Confidential Information otherwise than in the proper performance of the Services or as required by Law.

Data Protection

“Say Cheese” Dental Tours” will always respect your privacy and any personal communication between yourself and itself or any associated company. The information that “Say Cheese” Dental Tours” collects from you is only that required by “Say Cheese” Dental Tours” or any associated company to provide you with the information, products or services requested. “Say Cheese” Dental Tours” does not trade, rent or sell client details to third parties. Should “Say Cheese” Dental Tours” intentions change it will be done only with your authorisation. “Say Cheese” Dental Tours” will always comply with any data protection legislation currently in force.

Except where expressly permitted by Foreign and or Ukrainian data protection legislation, “Say Cheese” Dental Tours” will only deal with the personal details provided by you in respect of the provision of the Services, unless you agree otherwise. This will include sending you information about “Say Cheese” Dental Tours” services generally and to inform you about promotions, offers or information provided by “Say Cheese” Dental Tours” your personal details with those companies for this purpose.

“Say Cheese” Dental Tours” may transfer your personal details to a third party as part of a sale of some or all of its business and assets to any third party or as part of any business restructuring or reorganisation; however, “Say Cheese” Dental Tours” will take reasonable steps with the aim of ensuring that your privacy rights are protected.

Other than as set out above, “Say Cheese” Dental Tours will not disclose any of your personal details without your permission unless “Say Cheese” Dental Tours” is required by law to do so (for example, if required to do so by a court order or for the purposes of prevention of fraud or other crime).

You are always in control of your personal details. You can tell “Say Cheese” Dental Tours” in writing not to transfer your personal details as set out above by writing to “Say Cheese” Dental Tours” customer Care at our address.

Liability

In addition to any liability expressly or by implication excluded under these Trading Terms, “Say Cheese” Dental Tours” shall not be liable for consequential losses and its liability shall not in any case exceed a total amount equivalent to the amount payable by the patient for the treatment s/he received.

Other

These Trading Terms and the associated Treatment Plan constitute the entire agreement between the parties and supersedes any previous agreement or understanding. You expressly confirm that you have not entered into this contract on the basis of any representation that is not expressly incorporated into this contract.

Any modifications to the Treatment Plan or Trading Terms must be made in writing and agreed by the parties. The price initially quoted by us will be confirmed after further medical evaluation by the dentist.

“Say Cheese” Dental Tours” reserves the right to update or change these Trading Terms from time to time to reflect changes in its operating practice, changes in law affecting the provision of its Services or for other good reasons. It is your responsibility to be aware of such changes, which will take effect when posted.

Foreign law shall apply to this contract and the parties agree to submit to the exclusive jurisdiction of the Foreign Courts. In the event of a dispute arising under or in connection with this contract, the parties shall first attempt to resolve such dispute amicably through conciliation. If the parties are not able to resolve the dispute amicably within thirty days (30), starting from the date on which one party provided the other party with full written particulars of the nature of the dispute, then either party may seek the determination of the Foreign Courts.
